Ruku qilganda tizzalari ozgina bukilish kerakmi,\u201d<\/em> deb so\u02bbralgan savolga ayrim qo\u02bbshtirnoq ichidagi olimlar: <em>\u201cBu aytilgan gaplar Hanafiy mazhabini(ng) ijtihodlaridan. Daliliga ba\u02bczi bir asarlar keltirilgan hanafiy fiqhida. Lekin asarlari sahih (e)mas, hujjat bo\u02bbladigan dalil emas. Ayollar o\u02bbzi namoz masalasida \u201cAyollar erkaklarni(ng) tengidir\u201d. Illo dalil ajratgan joylar, sahih dalil bilan ajratilsa, ajratiladi. Shuning uchun hozirgi aytilgan narsalar hanafiy mazhabning ijtihodi. Agar o\u02bbsha mazhabda mana shu to\u02bbg\u02bbri deb e\u02bctiqod qilgan bo\u02bblsa, o\u02bbsha mazhabga amal qiladi. Lekin dalil jihatdan olganda \u201cAyollar erkaklarni(ng) tengidir\u201d hadisi bulardan ko\u02bbra quvvatli hisoblanadi. Dalil jihatdan qaraganda tirsagini tekkizmasligi va tizzasini ham to\u02bbg\u02bbri qilishi quvvatli bo\u02bblib ko\u02bbrinadi\u201d, <\/em>deb javob bergan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Quyida yuqorida aytilgan bu javobni tahlil qilamiz, xulosa sizdan, aziz o\u02bbquvchi!<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ta\u02bckidlab o\u02bbtish kerakki, shar\u02bciy masalalar javobida: <em>\u201cBu aytilgan gaplar hanafiy mazhabini(ng) ijtihodlaridan. Daliliga ba\u02bczi bir asarlar keltirilgan hanafiy fiqhida. Lekin asarlari sahih (e)mas, hujjat bo\u02bbladigan dalil emas\u201d, <\/em>kabi so\u02bbzlar bilan inkor ohangida, mensimagan holda gapirish salafi solih ulamolarimizga nisbatan hurmatsizlik, past nazar bilan qarash sanaladi. Albatta, bunday ohangda gapirish ortida ularning o\u02bbz maqsadi bor, ya\u02bcni olimlarni behurmat qilish orqali turkiy tilda, xususan, o\u02bbzbek tilida so\u02bbzlashuvchi xalqning qon-qoniga singib ketgan hanafiylikni yo\u02bbqotish maqsadi yotadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Olimlikni da\u02bcvo qilib, salafi solihlar yo\u02bblini va ularning ibodatlarga oid bergan fatvolari haqida \u201c<em>asarlari sahihmas, hujjat bo\u02bbladigan dalil emas\u201d,<\/em> deyish uchun inson munofiq bo\u02bblishi kerak. Sog\u02bblom fikrli musulmon kishi salafi solihlar haqida bunday so\u02bbzlarni aytmaydi. Chunki, Imom Abu Hanifa 1 mln.ga yaqin hadisni sanadi bilan, Imom Ahmad ibn Hanbal esa 500 mingdan ortiq hadisni sanadi bilan yoddan bilganini e\u02bctiborga olsak, faqihlar ijtihodi o\u02bbz-o\u02bbzidan paydo bo\u02bblib qolmaganini anglab yetamiz.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu fatvolarning vujudga kelishida Qur\u02bconi karim oyatlari va Payg\u02bbambarimiz sollallohu alayhi vasallamning muborak hadislari, sahobai kiromlar va tobeinlarning asarlari muhim asos bo\u02bblib xizmat qilgan. Mujtahid ulamolarimiz o\u02bbz fatvolariga oyat va hadislardan, sahoba va tobeinlarning so\u02bbzlaridan ortiq yana qanday hujjatni manba qilib olishi kerak. Ta\u02bclimni sahoba va tobeinlardan olgan Abu Hanifaning fatvolari sahih emas, zaif bo\u02bblar ekan-da, ta\u02bclimni Ibn Taymiyadan olgan mana bu odamlarning fatvolari sahih bo\u02bblar ekan. Mantiqni qarang. Hayron qolasiz! Bunday kimsalar aytayotgan so\u02bbzlarni aql tarozusiga qo\u02bbymay qabul qilayotgan insonlarning o\u02bbta soddaligi kishini yanada hayratga soladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Shubhasiz, mazhab peshvolari Qur\u02bconi karim va hadislar, har bir oyatning sababi nuzuli va har bir hadisning vorid bo\u02bblish sabablari, tafsiri va ta\u02bcvillari bilan to\u02bbliq yoddan bilgan. Mana shu bilim va salohiyati bilan bir qatorda, ularning har biri ulkan fahmu farosat sohiblari bo\u02bblgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Abu Hanifa o\u02bbz fahmu farosatining yuksakligidan 600 mingdan ortiq voqelikdagi masalaning yechimini to\u02bbg\u02bbri topib, fatvo bergan va uni zamondosh ulamolari to\u02bbg\u02bbri deb topgan. Imom Abu Hanifa farosat va fahmining o\u02bbtkirligidan hali voqelikda sodir bo\u02bblmagan, ammo kelajakda yuz berishi mumkin bo\u02bblgan 80 ming masalaning yechimini aytib bergan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Salafi solihlar ilmu irfonning mana shunday yuksak cho\u02bbqqisiga yetib fatvo bergan. Shu sababli, ularning Qur\u02bconi karim va sunnati mutahharrodan ijtihod qilib chiqargan fatvolari asrlar osha musulmonlar uchun dasturil amal bo\u02bblib xizmat qilib kelgan. Ahli sunna val jamoa musulmonlari bu to\u02bbrt mazhab peshvolarining chiqargan fatvolarini to\u02bbg\u02bbri va haq deb hisoblaydi. Aslida ham shunday.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Endi o\u02bbzini salafi solihlar yo\u02bblini tutganini da\u02bcvo qilgan, aslida esa, salafi solihlarga qarshi goh oshkora, goh pinhona gapirayotgan kimsalar qancha hadisni yod bilar ekan. Komil ishonch bilan aytish mumkinki, ular 100 yoki\u00a0 200 ta hadisni yoddan aytib berishi mumkin. Ammo, undan ortiq aytib bera olmaydi. Agar sanadi bilan aytib ber, deyilsa, to\u02bbrt dona hadisni ham aytib bera olmasligi aniq.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ular mana shunday sayoz bilimi bilan ahli sunna val jamoa ulamolari haq deb bilgan mazhabni inkor qilib, shar\u02bciy masalalarda ijtihod qilmoqda. Ular shunday bilimi bilan rojih marjuh qilib fatvo bermoqda. Bunday holatda ijtimoiy tarmoqda fatvo berayotgan, ko\u02bbrinishidan olim, aslida savodsiz kimsalarni Abu Hanifa rahimahulloh bilan qiyoslashning hojati yo\u02bbqdir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bunday kimsalar fikrini o\u02bbziga o\u02bbxshagan savodsiz kimsalar ma\u02bcqullamasa, ahli sunna val jamoa ulamolaridan birortasi ularning so\u02bbzini tasdiqlamaydi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Salafi solih ulamolarimiz va mujtahidlarimiz to\u02bbplagan ilmni toqqa qiyos qilsak, bunday kimsalar bilimi go\u02bbyo iste\u02bcmolga yaroqsiz bir dona tuxum kabidir. Majoziy ma\u02bcnoda aytganda, ular o\u02bbziga ergashgan kimsalarga palag\u02bbda tuxum yedirmoqda.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yuqoridagi qiyosimizning haqiqat ekaniga yana bir dalil shuki, asrlar osha mazhab peshvolari va mujtahid ulamolar ijtihodi musulmonlar tomonidan istifoda qilib kelinmoqda.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Mazhab peshvolari va mujtahid ulamolarga tosh otayotgan bunday \u201colimlar\u201dning fatvolari esa ularning bu dunyodan ketishi bilan yoki undan ham oldin musulmonlar nazaridan chetda qoladi. Chunki, tarixda islom dini dushmanlari tomonidan muqaddas dinimizga tosh otuvchi yuqoridagiga o\u02bbxshash chalasavod olimlar ko\u02bbplab tayyorlangan va bu holat davom etaveradi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bir vaqtlar o\u02bbzini hanafiy hisoblagan bu shaxsning <em>\u201cAyollar o\u02bbzi namoz masalasida erkaklarni(ng) tengidir\u201d. Illo dalil ajratgan joylar, sahih dalil bilan ajratilsa, ajratiladi. Shuning uchun hozirgi aytilgan narsalar hanafiy mazhabining ijtihodi\u201d, <\/em>degan so\u02bbzlari zamirida hanafiylar fatvosiga amal qilmasangiz ham bo\u02bblaveradi, degan ma\u02bcno yotadi. Bundan esa, uning qalbida hanafiy mazhabiga nisbatan nafrat mavjud ekanini anglash mumkin.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Javobda zikr qilingan: <strong><em>\u201cAyollar erkaklarning tengidir\u201d<\/em><\/strong> hadisiga to\u02bbxtalamiz. Oisha roziyallohu anhodan rivoyat qilinadi:<\/span><\/p>\n<p dir=\"rtl\" style=\"text-align: justify;\"><strong><span style=\"font-family: 'arial black', sans-serif; font-size: 14pt;\">\u0639\u0646 \u0639\u0627\u0626\u0634\u0629\u064e \u0623\u0645\u0651\u0650 \u0627\u0644\u0645\u0624\u0645\u0646\u064a\u0646\u00a0\u0631\u064e\u0636\u0650\u0649\u064e \u0627\u0644\u0644\u0647\u064f \u0639\u064e\u0646\u0652\u0647\u0627 \u0642\u0627\u0644\u064e\u062a\u0652: \u0642\u0627\u0644 \u0627\u0644\u0646\u0651\u064e\u0628\u064a\u0651\u064f \ufdfa : \u0625\u0650\u0646\u0651\u064e\u0645\u064e\u0627 \u0627\u0644\u0646\u0651\u0650\u0633\u064e\u0627\u0621\u064f \u0634\u064e\u0642\u064e\u0627\u0626\u0650\u0642\u064f \u0627\u0644\u0631\u0651\u0650\u062c\u064e\u0627\u0644\u0650 \u0645\u064e\u0627 \u0623\u0643\u0631\u064e\u0645\u064e\u0647\u064f\u0646\u0651\u064e \u0625\u0644\u0651\u0627 \u0643\u0631\u064e\u064a\u0645\u064c \u0648\u064e\u0645\u064e\u0627 \u0623\u0647\u064e\u0627\u0646\u064e\u0647\u064f\u0646\u0651\u064e \u0625\u0644\u0651\u0627 \u0644\u064e\u0626\u0650\u064a\u0645.<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Rasululloh sollallohu alayhi vasallam bunday dedilar<strong><em>: \u201cAlbatta, ayollar erkaklarning ikkinchi yarmidir<\/em><\/strong> (ya\u02bcni tengidir).\u201d<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a> Bu hadisning vorid bo\u02bblish sababi uyquda ehtilom bo\u02bblib qolish va undan g\u02bbusl qilish masalasi bo\u02bblib, bunda ayollar erkaklar bilan teng ekanligi, agar\u00a0 ular uyquda ehtilom bo\u02bblib qolsa, erkaklar kabi ularga ham g\u02bbusl vojib bo\u02bblishi aytilgan. Bu hadis zamiridagi hukm boshqa ibodatlarga ham qiyos qilinadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Shuningdek, ushbu hadis islomda erkaklarning qanday imtiyozlardan foydalanish huquqi bo\u02bblsa, ayollarning ham shunday huquqqa ega ekanini anglatadi. Ayrim o\u02bbrinlarda, xususan, jazoning ijro etilishida ayollar huquqi erkaklar huquqidan yuqori qo\u02bbyiladi, hatto, jinoyatga jazo berishda erkak kishiga berilmaydigan imtiyozlar ayollarga berilgan. Chunki, hadisning davomida Rasululloh sollallohu alayhi vasallam: <strong><em>\u201cAyollarni faqat hurmatli kishilargina hurmat qiladi, ularni faqat pastkash kishilargina xorlaydi\u201d,<\/em><\/strong> deganlar. Alloh taolo Qur\u02bconi karimda ham ularga nisbatan yaxshi muomalada bo\u02bblishga buyuradi:<\/span><\/p>\n<p dir=\"rtl\" style=\"text-align: justify;\"><strong><span style=\"font-family: 'arial black', sans-serif; font-size: 14pt;\">\u00a0\ufd3f\u0648\u064e\u0639\u064e\u0627\u0634\u0650\u0631\u064f\u0648\u0647\u064f\u0646\u0651\u064e \u0628\u0650\u0627\u0644\u0652\u0645\u064e\u0639\u0652\u0631\u064f\u0648\u0641\u0650\ufd3e\u00a0<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>\u201cUlar bilan totuv turmush kechiringiz\u201d<\/strong><a href=\"#_ftn2\" name=\"_ftnref2\"><strong><sup>[2]<\/sup><\/strong><\/a><strong>.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Darhaqiqat, islom dinida har bir jon egasi, jumladan, inson zotining huquqlari ham kafolatlangan va tabiatga zarar bermaslikka buyurilgan. Xususan, oyat va hadislarga muvofiq ayolning haqi qattiq himoyalangan. Islom zulmning har qanday ko\u02bbrinishiga qarshi bo\u02bblgan tenglik dinidir. Ayol va erkak huquqiy masalalarda ilohiy mezonga binoan tengdir. Ammo, bu ayollar erkaklarga berilgan huquqdan, erkaklar esa ayollarga berilgan huquqdan foydalanishi mumkin, degani emas. Alloh taolo O\u02bbzining ilohiy mezoni bilan erkak va ayolning har birining huquqini o\u02bbzlarining xilqatiga munosib ravishda aniq chegaralar bilan belgilab qo\u02bbygan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Shu sababli ayrim o\u02bbrinlarda erkaklar (masalan, harbiy ishlar, og\u02bbir mehnat, oilani boshqarish) ustun bo\u02bblsa, ayrim o\u02bbrinlarda ayollarning huquqlari erkaklardan ustundir (masalan, oila qurishda ayolning mahr olishi, o\u02bbzi ishlab topgan pulini oilasiga ishlatmaslik huquqi, og\u02bbir ishlarga jalb etish mumkin emasligi, hayz va nifos holatlarida namozning soqit bo\u02bblishi, farzandlar zimmasida onalar haqining otalarga nisbatan uch barobar ortiqligi, ayol jinoyat sodir etsa, jazoga tortilishda bir qator yengilliklar berilgani kabilarni aytish mumkin).<\/span><\/p>\n<div style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 12pt;\"><a href=\"#_ftnref1\" name=\"_ftn1\"><sup>[1]<\/sup><\/a> Imom Abu Dovud.
