Uning ma\u02bcruzalarida vijdon erkinligining haqiqiy mohiyati buzib ko\u02bbrsatilgan va unda kafolatlangan islomiy hamda huquqiy asoslar e\u02bctiborsiz qoldirilgan. Aytayotgan fikrlarida radikal g\u02bboyalar ochiq ko\u02bbrinmasa-da, bu orqali \u201cvijdon erkinligi\u201d tushunchasini salbiy ma\u02bcnoda talqin qilib, musulmonlar orasida bahs-munozara qo\u02bbzg\u02bbashga urinayotgani ko\u02bbrinib turibdi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Sodiq Samarqandiyning bu fikrlari nafaqat O\u02bbzbekiston Respublikasi qonunlariga munosabatini, balki uning diniy qarashlardagi shar\u02bciy pozitsiyani ham ko\u02bbrsatib beradi. Uning fikrlarida \u201cVijdon erkinligi\u201d tushunchasi to\u02bbg\u02bbri ta\u02bcrifdan chiqarilib, musulmonlar ichidagi fiqhiy ixtilof himoyasiga yo\u02bbnaltirib ko\u02bbrsatilgan. Bu esa mazkur qonunning huquqiy va diniy mohiyatini buzib ko\u02bbrsatish deb qaraladi. Aslida, \u201cVijdon erkinligi\u201d \u2013 ular o\u02bbylaganidek, ibodatlarida ixtilofli amallarni qiluvchilarni himoya qilish kafolati emas, balki din tanlash va uni erkin amal qilish huquqidir. Bu haqda quyida navbati bilan to\u02bbxtalamiz.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">BMT Inson huquqlari umumjahon deklaratsiyasi, 18-moddasida: <em>\u201cHar bir inson fikr, vijdon va din erkinligi huquqiga egadir. Bu huquq o\u02bbz dini yoki e\u02bctiqodini o\u02bbzgartirish, uni targ\u02bbib qilish, amal qilish va ibodatda erkinlikni o\u02bbz ichiga oladi\u201d<\/em><a href=\"#_ftn1\" name=\"_ftnref1\"><em><strong>[1]<\/strong><\/em><\/a>, deb din erkinligi alohida ta\u02bckidlab qo\u02bbyilgan. \u201cVijdon erkinligi\u201d \u2013 insonning din tanlash, uni erkin bajarish yoki umuman din tutmaslik huquqi bo\u02bblib, bu huquq ko\u02bbplab islomiy davlatlar konstitutsiyalarida e\u02bctirof etilgan. Jumladan, Sodiq Samarqandiy istiqomat qilib turgan davlatning qonunlarida ham mavjud.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">O\u02bbzbekiston Respublikasi Konstitutsiyasida 35-moddasida ham:\u00a0 <em>\u201cHamma uchun vijdon erkinligi kafolatlanadi. Har kim xohlagan dinga e\u02bctiqod qilish yoki hech qaysi dinga e\u02bctiqod qilmaslik huquqiga ega. Diniy qarashlarni majburan singdirishga yo\u02bbl qo\u02bbyilmaydi,\u201d<\/em><a href=\"#_ftn2\" name=\"_ftnref2\"><em><strong>[2]<\/strong><\/em><\/a> so\u02bbzlari bilan ko\u02bbp millatli diyorimizdagi fuqarolarning diniy erkinligi kafolatlangan. Bu qonun musulmonlarning ham, boshqa din vakillarining ham diniy amallarini himoya qiladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Demak, \u201cVijdon erkinligi \u2013 insonning shaxsiy huquqi va kafolatidir. Islom ham bu huquqni e\u02bctirof etadi va hurmat qilishni buyuradi. Unga aralashish yoki uni buzish mutlaqo mumkin emas. Islom dinida ham, qonunchiligimizda ham vijdon erkinligi ibodatlardagi far\u02bciy amallar himoyasi emas, balki dinni tanlash, o\u02bbz e\u02bctiqodini erkin amalga oshirish, zo\u02bbrlash va tazyiqdan himoyalanish huquqi sifatida talqin qilinadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Musulmon kishi, ayniqsa olim kishi har bir narsadan illat qidirmay, uning jamiyat va musulmonlar uchun foydali tomonlarini ochiqlashda, jumladan, \u201cVijdon erkinligi\u201d tushunchasini talqin qilish va izohlashda ham xolis bo\u02bblishga harakat qilish kerak Sodiq Samarqandiyning fikrlari esa vijdon erkinligini noto\u02bbg\u02bbri talqin qilib, Qonunning ushbu moddasi o\u02bbz ichiga olgan ma\u02bcno va maqsaddan boshqa ma\u02bcnoga burish, musulmonlarning e\u02bctiqodiga gumon bilan qarash va jamiyatda ixtilof uyg\u02bbotishdan boshqa narsa emas. Shu bois musulmon kishi bunday noto\u02bbg\u02bbri talqinlarga ergashmasligi, balki Qur\u02bcon va sunnatda Konstitutsiyamizda belgilab qo\u02bbyilgan vijdon erkinligi tamoyillarini to\u02bbg\u02bbri tushunib amal qilishi lozim.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Islomda \u201cVijdon erkinligi\u201d masalasiga qaraydigan bo\u02bblsak, dinimizda har bir insonning din tanlash va e\u02bctiqodda erkin bo\u02bblish huquqi bor. Albatta, to\u02bbg\u02bbri yo\u02bbl adashgan yo\u02bbldan ravshan ajralib turibdi\u201d<\/strong><a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ibn Kasir tafsirida bu oyatni: \u201c<em>Alloh Taolo dinni zo\u02bbrlab qabul qildirishni harom qildi, chunki haqiqat va yo\u02bbl ochiq-oydindir,\u201d<\/em><a href=\"#_ftn4\" name=\"_ftnref4\"><em><strong>[4]<\/strong><\/em><\/a> deb tafsir qilgan..<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Nabiy sollallohu alayhi vasallam ham boshqa din vakillariga dinlariga erkin amal qilish imkonini bergan. Masalan, Madinadagi musulmonlar bilan yahudiylar va nasorolar orasida tuzilgan \u201cVasiqatul Madina\u201d (Madina shartnomasi)da har bir jamoaning o\u02bbz diniga erkin amal qilish huquqi kafolatlangan<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ibodat masalasida turli mazhablarning hukm olish bo\u02bbyicha o\u02bbz uslubi mavjud. Masalan, raf\u02bcul-yadayn (qo\u02bblni ko\u02bbtarish) masalasida ulamolar turlicha ijtihod qilgan. Ulamolar hukmi ixtilofli amallar masalasida musulmonlar orasida tortishishni, ayniqsa, bir-birini malomat qilishni man etgan. Bu haqda Imom Navaviy: \u201c<em>Ixtilofli masalalarda bir-birini ayblash yoki malomat qilish haromdir,\u201d<\/em><a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a> degan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Mujtahid faqihlar nazdida raf\u02bcul yadayn (namoz ruknlari orasida ikki qo\u02bblni ko\u02bbtarish) amalini zavoid amallardan<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> bo\u02bblib, bahs-munozaraga arzimaydigan ixtilofiy masala sifatida qabul qilingan<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a>. U: \u201cSizlarga Rasululloh sollallohu alayhi vasallam namozlarini o\u02bbqib ko\u02bbrsataymi?\u201d dedi va namoz o\u02bbqib berdi. Aksincha, ularga islomdagi ayrim amallar tortishishga arzimasligini, bunday amallarni ko\u02bbtarib chiqib, musulmonlar orasida ixtilofga sabab bo\u02bblmaslikni yaxshi so\u02bbzlar bilan tushuntirib berganlar.
