U shaxslarning kamsitish, ta\u02bcqib, davlat yoki boshqa guruhlarning aralashuvidan qo\u02bbrqmasdan o\u02bbz diniy e\u02bctiqodlarini amalga oshirish, ifoda etish va o\u02bbzgartirish erkinligini ta\u02bcminlashga qaratilgan. Bunday siyosatning asosiy jihatlariga shaxslarning o\u02bbz diniga e\u02bctiqod qilish huquqlarini himoya qiluvchi, diniy e\u02bctiqodlarga ko\u02bbra kamsitishlarni taqiqlovchi qonunlar, barcha dinlarga qonun ostida bir xil munosabatda bo\u02bblishini ta\u02bcminlash, birovni boshqasidan ustun qo\u02bbymaslik, shaxslarga o\u02bbz diniy e\u02bctiqodlarini ochiq va maxfiy tarzda ifoda etishiga ruxsat berish, hukumatlar yoki hokimiyatlar diniy urf-odatlarga aralashmasligi, ta\u02bclim va jamoatchilikni xabardor qilish kampaniyalari orqali dinlarni tushunish va hurmat qilishni targ\u02bbib qilish kiradi. Mazkur siyosat turli diniy guruhlar o\u02bbrtasida tinch-totuv yashash va hurmatni mustahkamlash, ijtimoiy barqarorlik va totuvlikka hissa qo\u02bbshishga qaratilgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Diniy bag\u02bbrikenglik siyosati xalqaro huquqiy, jumladan, BMTning 1948-yil 10-dekabrda qabul qilingan Inson huquqlari bo\u02bbyicha umumjahon deklaratsiyasi va milliy qonunchilik me\u02bcyorlari bilan barcha davlatlarda ta\u02bcminlanishi yo\u02bblga qo\u02bbyilgan bo\u02bblsa-da, har bir davlatning bu borada o\u02bbziga xos xususiyatlari mavjud. AQSH Konstitutsiyasiga kiritilgan birinchi tuzatish o\u02bbzining ikki bandida din erkinligini ham, cherkov va davlatning ajralishini ham kafolatlaydi. Hukumatga ma\u02bclum bir dinni o\u02bbrnatish yoki qo\u02bbllab-quvvatlashni taqiqlaydi. Bu davlat tomonidan homiylik qilinadigan din yaratilishining oldini oladi va barcha dinlarga teng munosabatda bo\u02bblishini ta\u02bcminlaydi [14]. Shaxslarga hukumatning ortiqcha aralashuvisiz o\u02bbz dinini erkin e\u02bctiqod qilish huquqini kafolatlay-di. Bu diniy plyuralizm muhitini rivojlantiradi va odamlarga ta\u02bcqibdan qo\u02bbrqmasdan o\u02bbz e\u02bctiqodlariga amal qilish imkonini beradi [11]. Bu tamoyillar o\u02bbz davri uchun inqilob bo\u02bblsa-da, chegaralangan emas edi. Dastlabki Amerika jamiyati, asosan protestantlar, ko\u02bbpincha xristian bo\u02bblmagan dinlar uchun haqiqiy tenglik tushunchasi bilan kurashardi. Ko\u02bbpincha diniy e\u02bctiqodlari sabab chetga surilgan mahalliy amerikaliklar va qul bo\u02bblgan afrikaliklarga bo\u02bblgan munosabat bu yuksak g\u02bboyalarni amaliyotga tatbiq etish uchun dastlabki kurashlarni aks ettiradi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">AQSHdagi diniy bag\u02bbrikenglik evolyutsiyasini tarixiy bosqichlar orqali ifodalash mumkin. XVIII-XIX asrlarda Konstitutsiya diniy erkinlik uchun asos yaratgan bo\u02bblsa-da, Amerikaning dinga bo\u02bblgan munosabat va diskriminatsiyaning murakkab holatini boshdan kechirdi [15]. Protestantlik konfessiyalari ustun mavqega ega bo\u02bblib, katoliklik, shuningdek, iudaizm kabi boshqa nasroniy e\u02bctiqodlari adovat va jamiyatdan chetlanishga duch kelgandi. Reynolds Qo\u02bbshma Shtatlarga qarshi [5:7-10] va Kantvell Konnektikutga qarshi [3:142-161] kabi holatlar jamiyat me\u02bcyorlariga zid bo\u02bblsa ham,\u00a0 erkin e\u02bctiqod qilish huquqini qo\u02bbllab-quvvatlovchi pretsedentlarni o\u02bbrnatdi. 1960-yillardagi Fuqarolik huquqlari harakati diniy erkinlik doirasini kengaytirdi. Xususan, 1964-yilgi Fuqarolik huquqlari to\u02bbg\u02bbrisidagi qonun [1:383-399] va 1965-yildagi Ovoz berish huquqi to\u02bbg\u02bbrisidagi qonun kabi muhim qonunlar dinidan qat\u02bci nazar, barcha amerikaliklar uchun teng huquqlarni ta\u02bcminladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">AQSH hukumati turli diniy jamoalar o\u02bbrtasida o\u02bbzaro tushunish va hamkorlikni rivojlantirishga qaratilgan dinlararo muloqot va tashabbuslarni qo\u02bbllab-quvvatlaydi. Bu konferensiyalar, o\u02bbquv dasturlari va jamoatchilikni xabardor qilish kampaniyalariga homiylik qilishni o\u02bbz ichiga oladi. Ko\u02bbplab notijorat tashkilotlar va dinlararo koalitsiyalar diniy guruhlar o\u02bbrtasida muloqot, tushunish va hamkorlikni rivojlantirish uchun ishlaydi. Ushbu sa\u02bcy-harakatlar ko\u02bbpincha umumiy ijtimoiy muammolarni hal qilishga, jamiyatning faolligini oshirishga va dinlar o\u02bbrtasida mustahkam aloqa o\u02bbrnatishga qaratilgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Yevropa Ittifoqi<\/strong> tomonidan 1950-yilda qabul qilingan Inson huquqlari bo\u02bbyicha Yevropa konvensiyasi Yevropada inson huquqlariga oid eng muhim hujjatlardan biridir [10: 217-231]. Inson huquqlari bo\u02bbyicha Yevropa konvensiyasining 9-moddasi fikr, vijdon va din erkinligi huquqini kafolatlab, o\u02bbz dinini yoki e\u02bctiqodini o\u02bbzgartirish erkinligini hamda o\u02bbz dinini yoki e\u02bctiqodini ibodat, ta\u02bclimot, amaliyot va marosimlarda yakka o\u02bbzi yoki boshqalar bilan birgalikda, ochiq yoki yopiq ravishda e\u02bclon qilish erkinligini o\u02bbz ichiga oladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2000-yilda e\u02bclon qilingan va 2009-yilda Lissabon shartnomasi bilan qonuniy kuchga ega bo\u02bblgan Yevropa Ittifoqining Asosiy Huquqlar Xartiyasi inson huquqlari bo\u02bbyicha boshqa xalqaro hujjatlarda mustahkamlangan huquq va erkinliklarni mustahkamlaydi va tasdiqlaydi [6:137-170]. Nizomning 10-moddasi fikrlash, vijdon va din erkinligi huquqini ochiq-oydin kafolatlaydi, bu Inson huquqlari bo\u02bbyicha Yevropa konvensiyasining 9-moddasi qoidalariga mos keladi. Ushbu asos diniy erkinlikning boshqa asosiy huquqlar bilan bir qatorda himoya qilinishini ta\u02bcminlaydi va Yevropa Ittifoqining inson huquqlari va demokratik qadriyatlarga sodiqligini mustahkamlaydi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Diniy qarama-qarshiliklarning uzoq tarixi va kuchli dunyoviylik an\u02bcanalariga ega bo\u02bblgan <strong>Fransiya<\/strong> din va davlat o\u02bbrtasida qat\u02bciy ajratish modelini qabul qilgan. \u201cLa\u00efcit\u00e9\u201d deb nomlanuvchi bu yondashuv diniy e\u02bctiqodlarning ommaviy ifodasini cheklash orqali barcha fuqarolar uchun tenglik va betaraflikni ta\u02bcminlashga qaratilgan. 1905 yilda qabul qilingan \u201cCherkovlar va davlatni ajratish to\u02bbg\u02bbrisida\u201dgi qonun fransuz dunyoviyligining asosini tashkil etadi. Ushbu qonun diniy tashkilotlarning davlat mablag\u02bblarini olishni taqiqlaydi va jamoat joylarida, jumladan, maktablarda diniy ramzlarni namoyish qilishni cheklaydi [4:259-296]. Fransiya o\u02bbsib borayotgan musulmon aholisini integratsiyalashda jiddiy muammolarga duch kelmoqda. \u201cLa\u00efcit\u00e9\u201dning qat\u02bciy qo\u02bbllanilishi maktablarda ro\u02bbmol o\u02bbrash, hijob kiyishni taqiqlash va jamoat joylarida diniy urf-odatlarni cheklash bilan bog\u02bbliq bahs-munozaralarga olib keldi [2:11-19]. Bu chora-tadbirlar tenglik va betaraflikni qo\u02bbllab-quvvatlashga qaratilgan bo\u02bblsa-da, musulmonlarning chetga surilishiga hissa qo\u02bbshgani va keskinlikni kuchaytirgani uchun tanqidga uchradi. Ayniqsa, musulmonlar jamiyatida ekstremistik mafkuralarning paydo bo\u02bblishi integratsiya jarayonini yanada murakkablashtirdi. Fransiya bunga javoban terrorizm va radikallashuvga qarshi kurash, jumladan, ekstremistik guruhlar faoliyatini taqiqlash va masjidlar monitoringini o\u02bbtkazish bo\u02bbyicha qonunlar qabul qildi. Biroq bu chora-tadbirlar haddan tashqari kuzatuv va fuqarolik erkinliklarining buzilishi ehtimoli haqidagi tashvishlarni uyg\u02bbotdi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Germaniya<\/strong> diniy erkinlik va dinlararo muloqotga katta e\u02bctibor beradigan davlatlardan biridir. Mamlakatda azaldan diniy bag\u02bbrikenglik an\u02bcanalari mavjud bo\u02bblib, u konstitutsiya va diniy ozchiliklarni himoya qilishga sodiqligida o\u02bbz ifodasini topgan. Germaniyaning Asosiy qonuni (Grundgesetz) diniy erkinlikni asosiy huquq sifatida mustahkamlab, ibodat erkinligini, diniy tashkilotlar tuzish huquqini va diniy ta\u02bclim olish huquqini kafolatlaydi [9:51-70]. 4-moddada shunday deyilgan: e\u02bctiqod, vijdon erkinligi, diniy yoki falsafiy e\u02bctiqodga e\u02bctiqod qilish erkinligi daxlsizdir; dinning buzilmasligi kafolatlanadi; hech kim o\u02bbz vijdoniga qarshi qurol ishlatish bilan harbiy xizmatni o\u02bbtashga majburlanishi mumkin emas. Tafsilotlar federal qonun bilan tartibga solinadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Germaniya diniy jamoalar bilan turli davlat shartnomalariga ega. Bu shartnomalar davlat va turli diniy tashkilotlar o\u02bbrtasidagi munosabatlarni tartibga soladi, ularga ma\u02bclum imtiyozlar beradi va ularning ommaviy-huquqiy maqomini tan oladi. Masalan, 1933-yili Vatikan va Germaniya o\u02bbrtasida imzolangan Reichskonkordat shartnomasi\u00a0 Germaniyadagi katolik cherkovining huquqlarini tartibga soladi [8:506-535]. Biroq oxirgi o\u02bbn yilliklarda immigratsiya bilan bog\u02bbliq muammolarning kuchayishi diniy va madaniy bag\u02bbrikenglik tamoyillarini izdan chiqaruvchi harakat va tashkilotlar vujudga kelmoqda. Ular immigrantlarni o\u02bbz milliy va madaniy qadriyatlariga tahdid sifatida ko\u02bbrib, boshqa din va madaniyat vakillariga nisbatan murosasizlik va muammolarni keltirib chiqarmoqda. Mamlakatda diniy erkinlikning azaliy an\u02bcanalari mavjud bo\u02bblib, cherkovlar va boshqa turli diniy guruhlar birgalikda totuv yashaydi. U Inson huquqlari bo\u02bbyicha Yevropa konvensiyasini ichki qonunchilikka kiritib, davlat organlarining Konvensiya bilan himoyalangan huquqlarga mos kelmaydigan xatti-harakatlarini noqonuniy qiladi. 9-modda fikr, vijdon va e\u02bctiqod erkinligi deb nomlanib, ushbu modda fikrlash, vijdon va e\u02bctiqod erkinligi huquqini, shu jumladan din yoki e\u02bctiqodni o\u02bbzgartirish erkinligi hamda o\u02bbz dini yoki e\u02bctiqodini ibodat, ta\u02bclim, amal va marosimlarda namoyon etish erkinligini kafolatlaydi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Xulosa qilib aytganda, jamiyat barqarorligini ta\u02bcminlashda diniy bag\u02bbrikenglik siyosati har bir davlat va jamiyatda o\u02bbziga xos xususiyatga ega bo\u02bblib, bu jamiyatlarning uzoq rivojlanish tarixi bilan bog\u02bbliq. O\u02bbrganilgan davlatlarda diniy muammolar va kamsitishlar uchrab tursa-da, jamiyat barqarorligi va tinchligi uchun diniy bag\u02bbrikenglik tamoyillariga amal qilishga harakat qilingan. Yuqorida ko\u02bbrib chiqqanimizdek, o\u02bbrganilgan barcha davlatlarda dinlararo munosabatlarni tartibga solish uchun milliy qonunchiliklar takomillashtirilgan va BMTning 1948-yilgi Inson huquqlari bo\u02bbyicha umumjahon deklaratsiyasi doirasida diniy bag\u02bbrikenglikni ta\u02bcminlash kafolatlarini olgan. Shu bilan birga, diniy bag\u02bbrikenglikni ta\u02bcminlashda o\u02bbziga yarasha qiyinchilik va muammolarga ham ega ekanligi ko\u02bbrinib turibdi. Bu ushbu masalani doim diqqat markazda tutib turishni, diniy bag\u02bbrikenglikda davlat nazoratini o\u02bbrnatish va uni takomillashtirilgan mexanizmlar asosida boshqarib turishni talab qiladi.
