Zakotning vojib bo\u02bblishiga kishining musulmon, oqil, balog\u02bbatga yetgan, moli nisobga yetgan hamda uning qo\u02bblida bir yil aylangan bo\u02bblishi shart qilinadi. [3, 24\\56] Nabiy (s.a.v) ham: \u201cIslom besh asos ustiga qurilgan \u201cLa ilaha illalloh va anna Muhammadan rosululloh\u201d deya guvohlik berish, namozni to\u02bbkis ado qilish, zakotni berish, haj qilish, va ramazon ro\u02bbzasini tutish\u201d, deganlar. [10, 1\\390. 11, 1\\223]\u00a0 Yana bir hadisi shariflarida esa: \u201cBiror tillo yoki kumush egasi bor ekan, agar haq (zakot)ni bermasa, qiyomat kunida uning uchun temirlar eritiladi, qizdiriladi, jahannam olovida uning ustiga tashlanadi, hamda uning yonlari va orqa tomonlariga bosiladi\u201d.\u00a0<em>[5, 2\\280]<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ushbu oyati karimada azoblanuvchilar kanz egalari ekani umumiy tarzda zikr qilingach, hadisi sharifda ularning aynan naqd pul sanalmish tillo va kumushlarning zakotini bermaydiganlar ekani ochiqlandi. Shunga ko\u02bbra har qanday molu davlat egasi azoblanadi emas, balki, uning zakotini bermaydiganlar azoblanadi, ma\u02bcnosida tushunish kerak bo\u02bbladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Tillo va kumushdan qanday zakot vojib bo\u02bbladi?<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Tillo va kumushdan zakot vojib bo\u02bblishida ham boshqa narsalardagi kabi zakotning umumiy shartlari \u2013 mol nisobga yetgan, bir yil aylangan bo\u02bblishi kerak.\u00a0<em>[9, 2\\4]\u00a0<\/em>Shunda tillo va kumushning har qanday turida zakot vojib bo\u02bblaveradi. Bu o\u02bbrinda ularning zarb qilingan yoki qilinmagani ahamiyatsizdir. Istilohda zarb qilingan tillo va kumush mahsulotlarini ayn va maskuk deyilsa, ishlanmagan, zarb qilinmagan holatdagilarini tibr deb nomlanadi. Demak tillo va kumushi zakot nisobiga yetgan va unga bir yil aylangan shaxs o\u02bbz molidan zakot chiqarishi shart bo\u02bbladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Faqat ikkita holat bundan mustasnodir:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Birinchisi tillo va kumushdan yasalgan taqinchoqlarning zakoti bo\u02bblib, uning vojibligida fuqaholarning ixtilofi bordir. Molikiy va shofeiylarning nazdida tillo yoki kumushdan yasalgan taqinchoqlar hatto oriya yoki ijaraga berilgan bo\u02bblsa ham undan zakot vojib bo\u02bblmaydi. Zero taqinchoqlar kiyim-kechak, ishchi hayvonlar kabi shaxsiy foydalanish uchun olib qo\u02bbyilgan buyumlarga o\u02bbxshaydi. Shaxsiy ehtiyoj uchun olingan buyumlarda zakot vojib bo\u02bblmaganidek, taqinchoqlarda ham zakot vojib bo\u02bblmaydi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Hanafiy mazhabi faqihlari esa tillo va kumushning boshqa turlarida zakot vojib bo\u02bblgani\u00a0 kabi taqinchoq holiga kelganlarida ham zakot vojib bo\u02bbladi, deydilar. [6, 1\\524.] \u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ikkinchisi mustasno holat esa yer ostidan qazib olingan tillo va kumush \u00a0bo\u02bblib, ular fiqhiy istilohda rikoz yoki kanz deyiladi. Bu degani rikozlardan zakot vojib bo\u02bblmaydi degani emas, balki, ulardan ham zakot vojib bo\u02bbladi. Bir misqolning og\u02bbirligi 4,25 grammdir. [12, 1\\24] Shunga ko\u02bbra yigirma misqolning og\u02bbirligi 85 gramm bo\u02bbladi.\u00a0 Tilloning miqdori\u00a0 20 misqoldan kam bo\u02bblsa, zakot vojib bo\u02bblmaydi. Ammo ba\u02bczi o\u02bbrinlarda tilloning nisobi boshqa mollarni unga qo\u02bbshgan holda to\u02bbldirilishi mumkin. Lekin bu ixtilofli masaladir. Tilloning nisobi borasida jumhur faqihlarga faqat Hasan Basriy (21-110 h, 641-728 m) gina xilof qilgan. Shunga ko\u02bbra qiymati ikki yuz dirhamga teng bo\u02bblgan tillodan zakot vojib bo\u02bbladi, uning yigirma misqol yoki undan kamroq yoxud ko\u02bbproq ekani ahamiyatsizdir. Zero Nabiy (s.a.v)dan tilloning nisobi borasida sahih hadis sobit emas. Shuning uchun uning nisobi kumushning nisobiga taqqoslanadi, deya o\u02bbz gaplariga izoh beradilar. [1\\524]<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Jumhur faqihlar esa tilloning nisobiga Nabiy s.a.v.ning: \u201cYigirma misqoldan kam tilloda ikki yuz dirhamdan kam kumushda zakot vojib emasdir\u201d, degan hadislarini dalil qiladilar. [14, 2\\93]<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Umar va Oisha r.a.larning hadislarida ham: \u201cNabiy s.a.v. har yigirma dinordan yarim dinor, qirq dinordan bir dinor zakot olar edilar\u201d, deyilgan. [15, 1\\571]<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kumushning nisobi<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Lug\u02bbatda ishlov berilgan, shaklga solingan kumushni \u0648\u0631\u0642 [variqun] yoki\u0631\u0642\u0629 \u00a0[riqatun] deyiladi. Yana bir lug\u02bbatda esa zarb qilingan bo\u02bblsa ham qilinmagan bo\u02bblsa ham variq deyilaveradi, deyilgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kumushning nisobi barcha faqihlarning ittifoqiga ko\u02bbra ikki yuz dirham ekani aytilgan. Bir dirhamning vazni hanafiy faqihlarining nazdida 3,125 grammga teng bo\u02bblsa boshqa fuqaholarning nazdida 2,975 grammga tengdir. Shunga ko\u02bbra kumushning vazni hanafiy faqihlarining gaplariga ko\u02bbra 625 grammga yetsa, boshqa mazhab sohiblarining nazdida 595 grammga yetganda zakot vojib bo\u02bbladi. Bu borada Nabiy (s.a.v)ning quyidagi hadisi shariflari vorid bo\u02bblgan: \u201cBesh uqiyaga yetmagan kumushdan sadaqa vojib bo\u02bblmaydi\u201d. Shunga ko\u02bbra besh uqiya ikki yuz dirham bo\u02bbladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu borada hazrati Anas (r.a)ning ham marfu hadislari bor bo\u02bblib, unda: \u201cKumushda qirqdan bir zakot vojibdir. Ba\u02bczi hanafiylarning nazdida esa kumushning zakotida har bir shaharning o\u02bbz dirhamlari son jihatidan hisoblanaveradi, shar\u02bciy me\u02bcyordagi dirham bilan bir xil bo\u02bblishi shart emas, deyilgan.
