Dastlabki saboqni Marg\u02bbilonda olgan alloma yoshligidayoq Qur\u02bconi karimni yodlab, hadis ilmidan mukammal ta\u02bclim olgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Keyinchalik Movarounnahrning o\u02bbsha davrdagi madaniy va ma\u02bcrifiy markazi bo\u02bblgan Samarqandga ko\u02bbchib borib, o\u02bbsha yerda istiqomat qilgan va ilmiy faoliyat yuritgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Manbalarda allomaning o\u02bbzga yurtlarga safar qilgani haqida ma\u02bclumotlar uchramaydi. \u201cBidayatul mubtadi\u201d asarining yozilishi tarixida zikr etilgan Bag\u02bbdod safari uning hajga keta turib, yo\u02bbl-yo\u02bblakay bu shaharda to\u02bbxtab o\u02bbtganiga ishoradir. O\u02bbz zamonasinig ilmli kishilaridan bo\u02bblgan Umar ibn Habib nabirasining tarbiyasiga jiddiy e\u02bctibor bilan qaragan va uning kelajakda yetuk alloma bo\u02bblib yetishishi uchun ko\u02bbp xizmat qilgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Marg\u02bbinoniyning boshqa ustozlari to\u02bbg\u02bbrisida alloma o\u02bbzining \u201cKitab al-mashaix\u201d (\u201cShayxlar haqidagi kitob\u201d) nomli asarida ma\u02bclumot berib o\u02bbtgan. Unda qirqdan ortiq allomaning nomi keltirilgan. Bu asar fiqhning muhim sohalaridan bo\u02bblgan meros ilmiga bag\u02bbishlangan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cAl-Majmu\u02bc al-Usmoniy\u201dning nusxasi mamlakatimiz qo\u02bblyozmalar xazinasida mavjud emas, degan fikrda yurar edik. Keyingi izlanishlar natijasida uning bir nechta qo\u02bblyozma nusxasi O\u02bbzbekiston Respublikasi Fanlar akademiyasi Sharqshunoslik institutining qo\u02bblyozmalar xazinasidan topildi. Shu paytgacha topilmagani va e\u02bctibordan chetda qolib kelganining asosiy sababi uning alohida qo\u02bblyozma shaklida emas, balki allomaning nabirasi Imoduddin Marg\u02bbinoniyning \u201cal-Fusul al-imodiyya\u201d asari tarkibida ekani bilan bog\u02bblik bo\u02bblib chikdi. \u201cAl-Majmu\u02bc al-Usmoniy\u201d \u201cal-Fusul al-imodiyya\u201d tarkibiga uning fasllaridan biri sifatida kiritilgan bo\u02bblgan. Chunki qirq fasldan iborat bo\u02bblgan kitobning o\u02bbttiz yettinchi fasli meros taqsimoti masalalariga oid bo\u02bblib, Imoduddinning e\u02bctiroficha, u bu mavzuga oid yangi asar yozib o\u02bbtirmasdan, bobosining \u201cal-Majmu\u02bc al-Usmoniy\u201d asarini qo\u02bbshib qo\u02bbya qolishga qaror qilgan.<a href=\"https:\/\/www.bukhari.uz\/?p=20395#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Asar haqidagi ma\u02bclumotlarning tahliliga o\u02bbtishdan avval ba\u02bczi mulohazalar. Gap shundaki, allomaning buyuk asari \u2013 \u201cHidoya\u201d islom olamida alohida e\u02bczoz va e\u02bctiborga sazovor bo\u02bblgan. Lekin undan \u201cfuqarolik huquqining muhim yo\u02bbnalishi hisoblangan meros ilmi mavzusi o\u02bbrin olmagan. Asar alohida kitob bo\u02bblib ta\u02bclif etilgani uchun shunday bo\u02bblsa kerak. Bir tomondan, uning hajmi unchalik katta emas. Yozuvning mayda-yirikligi va asar bitilgan qog\u02bbozning katta-kichik hajmda ekaniga qarab 8-10 varaqni tashkil etishi mumkin. Ikkinchi tomondan, meros ilmi islom ilmlari orasida eng qiyin soha hisoblanib, asardan faqat shu sohaga aloqador mutaxassislar foydalanishi mumkin. Ehtimol, shuning uchun ham boshqa fiqhiy asarlar singari ko\u02bbplab nusxalarda ko\u02bbchirilmagan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Nazarimizda, O\u02bbrta asrlarda bir muddat merosga oid asarlarni yirik fiqhiy asarlar tarkibiga kiritish odat bo\u02bblmagan. Faqat mo\u02bbg\u02bbullar bosqinidan keyingi davrda bitilgan fiqhiy asarlarda meros mavzusi o\u02bbrin ola boshlagan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ikkinchi mulohaza \u2013 Marg\u02bbinoniy qalamiga mansub ushbu asar \u201cal-Majmu\u02bc al-Usmoniy\u201d deb nomlangani. Bu xususda turli taxminlar bor. Birinchidan, Abdulqodir ibn Abul Vafo (1297-1373) \u201cal-Javohir al-Muzi\u02bca fi Tabaqot al-Hanafiya\u201d (\u201cHanafiylar tarjimai hollarida ziyo taratuvchi javohirlar\u201d)da bu asarni xalifa Usmon ibn Affonga yoki unga ergashganlarga nisbatan ta\u02bclif qilingani hamda \u201cKitob al-Faroiz\u201d unga tegishli ekanini zikr qilgan<a href=\"https:\/\/www.bukhari.uz\/?p=20395#_ftn6\" name=\"_ftnref6\">[6]<\/a>. Lekin Usmoniyning kimligi haqida birorta ma\u02bclumot bermagan, lekin\u00a0 uning Burhonuddin Marg\u02bbinoniy qalamiga mansubligi haqida ham so\u02bbz yuritmagan. Ikkinchi tomondan, asar ayni shu tarzda nomlanganining aniq sabablari bevosita qo\u02bblyozma manbalarda zikr qilingani yoki izohlangani topilmaganidir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Asarning boshlanishida Burhonuddin Marg\u02bbinoniyning o\u02bbzi e\u02bctirof etib, \u201cBir qorindan tug\u02bbishganlik rishtasi, murtadlar kabi va shunga o\u02bbxshash masalalar bo\u02bbyicha hukmlar musannif zikridan chetda qolgani\u2026\u201d<a href=\"https:\/\/www.bukhari.uz\/?p=20395#_ftn7\" name=\"_ftnref7\">[7]<\/a>\u00a0degan iboralarni yozgan. Demak, bu bilan alloma asarning dastlabki shaklida boshqa bir muallif bo\u02bblgani va u qandaydir sabablar bilan qator masalalarni uning tarkibiga kiritmagani haqida zikr qiladi. Bu holat bizga O\u02bbrta asrlarda yashab ijod etgan hanafiy allomalardan Abul Hasan Ali ibn Xizr ibn Hasan Qurashiy Dimashqiy Usmoniy (vaf. 1067)ga e\u02bctibor qaratishimizga turtki bo\u02bbldi. Bu kishi faroiz ilmining bilimdoni, matematik olim bo\u02bblib, \u201cIlm al-Hisob\u201d (\u201cHisob-kitob ilmi\u201d), \u201cal-Vafiyyot\u201d (\u201cSadoqatlilar\u201d), \u201cAt-Tazkira bi usul al-hisob va al-faroiz\u201d (\u201cMeros taqsimoti va hisob-kitob asoslarini bildirish\u201d) nomli asarlar muallifi bo\u02bblgan<a href=\"https:\/\/www.bukhari.uz\/?p=20395#_ftn8\" name=\"_ftnref8\">[8]<\/a>.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Burhonuddin Marg\u02bbinoniy ayni shu allomaning merosga oid asarini to\u02bbldirib, qayta ishlagan va shu sababdan uning dastlabki shaklini muallifning huquqini buzmaslik maqsadida \u201cal-Majmu\u02bc al-Usmoniy\u201d deb atagan bo\u02bblishi mumkin, degan fikrga keldik.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cAl-Majmu\u02bc al-Usmoniy\u201d asarining umumiy hajmi barcha nusxalarda deyarli bir xil.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Asarda dastlab meros mulkining ta\u02bcrifi keltirilgan. Undan ma\u02bclum bo\u02bbladiki, biror insonning vafotidan keyin qolgan mol-mulki meros mulki hisoblangan. Bu mulkning marhumni dafn qilish bilan bog\u02bblik bo\u02bblgan sarf-xarajatlar, agar uning qarzi bo\u02bblsa, qarzlarini ado etishga sarflangan mablag\u02bbdan keyin qolgan qismi merosxo\u02bbrlar orasida taqsimlanadigan ulush hisoblangan. Faroiz ilmida marhumning meros mulki xususida qoldirgan vasiyati, taqsimlanish uchun qolgan meros mulkining uchdan bir qismi miqdoridan oshmasligi belgilab qo\u02bbyilgan. Asarda meros olishi mumkin bo\u02bblgan qarindoshlar va ularning darajalari mufassal bayon qilingan. Merosxo\u02bbrlarning marhumga qarindoshlik nuqtai nazaridan ularga tegishi mumkin bo\u02bblgan miqdor belgilab qo\u02bbyilgan. Bu me\u02bcyor va mezonlar odamlar o\u02bbrtasidagi qarindoshlik rishtalari va darajalari nihoyatda xilma-xil bo\u02bblgani sababidan murakkab arifmetik tenglamalar va hisob-kitoblar asosida ishlab chiqilgan. Ular faroiz ilmining asosiy mazmun-mohiyatini tashkil etadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cAl-Majmu\u02bc al-Usmoniy\u201dda besh fasl va ikki mavzu qizil siyoh bilan alohida ajratib yozilgan. Dastlabki fasl \u201cOna tomonidan bo\u02bblgan qarindoshlarga oid fasl\u201d deb nomlangan bo\u02bblib, unda qarindoshlik darajasi belgilab berilgan. Bu yerda ona tomonidan bo\u02bblgan qarindoshlar besh turga bo\u02bblinishi va bu turlarning nomlari zikr qilingan. Umumiy ta\u02bcrif berilgandan so\u02bbng har bir sinfga oid me\u02bcyor va mezonlar alohida fasllarda birma-bir bayon qilingan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cBirinchi tur qarindoshlar haqidagi fasl\u201dda teng sharoitda merosga boshqalardan ko\u02bbra haqliroq bo\u02bblgan qarindoshlar haqida ma\u02bclumot beriladi va ularning darajalari belgilanadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cIkkinchi tur qarindoshlar haqidagi fasl\u201dda bu tur qarindoshlar sirasiga kimlar kiritilishi belgilab berilgan. Fasl mazmunidan bu toifaga ona tomonidan bo\u02bblgan bobo va buvilar kiritilishi ma\u02bclum bo\u02bbladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cUchinchi tur qarindoshlar haqidagi fasl\u201dda opa-singillarning o\u02bbg\u02bbil farzandlari va aka-ukalarning qiz farzandlari haqida so\u02bbz yuritiladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cTo\u02bbrtinchi tur qarindoshlar haqidagi fasl\u201dda ona amakilarining o\u02bbg\u02bbil farzandlari va ularning merosdagi ulushi haqida fikr bildiriladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cBeshinchi tur qarindoshlar haqidagi fasl\u201dda ota va ona tomonidan bo\u02bblgan boshqa qarindoshlar va ularning meros taqsimotidagi o\u02bbrinlari haqida ma\u02bclumotlar zikr kilinadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Meros mavzusi bilan bog\u02bbliq turli ishlar \u201cKitobga ilova qilingan masalalar haqidagi fasl\u201dda talqin qilingan.
