Gohida o\u02bbzining va ustozlari Abu Hanifa va Molikning qarashlari o\u02bbrtasidagi farqlarni ko\u02bbrsatishga batafsil kirishadi, masalaning turli holatlari va hukmlarini bayon qiladi. Buning misoli 18-bob (Burundan qon oqishi sababli tahorat olish bobi)da ko\u02bbrinadi. Buning misoli 5-bobda (Zakarni ushlash sababli tahorat olish bobi)da ko\u02bbrinadi. Muhammad ibn Hasan u yerda zakarni ushlash tahoratni sindirmasligini 16 ta hadis bilan isbotlashga uringan. Bu esa bitta bob doirasi juda katta qo\u02bbshimchadir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ayrim boblarda imom Molik ishtirokidan tashqari sanad bilan 6-7 ta hadisni keltiradi. Masalan, 17-bob (Juma kuni g\u02bbusl qilish bobi)da 6 ta qo\u02bbshimcha hadis keltirilgan. Bu ham kattagina qo\u02bbshimcha hisoblanadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Boshqa nusxalardagi aksar boblarda keluvchi \u201cMolik dedi:\u2026\u201d deb boshlanadigan fatvolar imom Muhammad \u201cMuvatto\u201dsida mavjud emas. Mazkur 175 ta hadisning 13 tasi Abu Hanifadan, 4 tasi Abu Yusufdan, qolganlari esa boshqalardan keltirilgan. [2: J. 1, B. 141; 3: B. 58]<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Fiqh ilmi mutaxassislarining taqsimlashicha, hanafiy mazhabida ta\u02bclif etilgan eng ahamiyatli kitoblar uch qismga: 1) \u201cZohirur rivoya\u201d va 2) \u201cZohirur rivoya\u201dga tenglashtirilgan kitoblar va 3) \u201cZohirur rivoya\u201d bo\u02bblmagan kitoblarga bo\u02bblinadi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cZohirur rivoya\u201d kitoblari muallifdan mutavotir yoki mashhur yo\u02bbl bilan rivoyat qilingan eng ishonchli manbalar bo\u02bblib, hanafiy mazhabida bu kitoblarda kelgan masalalarga qarshi fatvo berish mumkin emas degan usul qabul qilingan. Muhammad ibn Hasan ta\u02bclif etgan bu ensiklopedik xarakterdagi asarlarda mazhabboshilarning turli masalalardagi fatvolari to\u02bbplangan. \u201cZohirur rivoya\u201d darajasiga tenglashtirilgan\u201d kitoblar sirasiga birinchi o\u02bbrinda imom Muhammad \u201cMuvatto\u201dsi kiritilgan. [4: B 92-93]<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Mazkur asar qadimdan hanafiylar orasida darslik sifatida o\u02bbqitilgan. Jumladan, movarounnahrlik mashhur hanafiy olimi Abu Hafs Nasafiy (1068-1142) o\u02bbz ustozi Abu Mansur Horisiy (1046-1119) orqali \u201cMuvatto\u201dni eshitib, o\u02bbqigani ma\u02bclum. Bugungi kunda ham Turkiya, Pokiston va Hindistonda hanafiylar o\u02bbquv dargohlarida mazkur \u201cMuvatto\u201d rasmiy ravishda o\u02bbqitib kelinmoqda. [5: 2016 y., 3-son]<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Muhammad \u201cMuvatto\u201dsi boshqa \u201cMuvatto\u201dlar singari \u201cNamoz boblari\u201d bo\u02bblimi bilan boshlangan. Odatda hanafiy mazhabidagi mashhur fiqhiy asarlarda dastlab tahorat (poklik) va unga birinchi o\u02bbrinda aloqador bo\u02bblgan suvlar mavzulari batafsil yoritilgach, namozga taalluqli mavzular bayoniga kirishiladi. Bunga \u201cAl-Hidoya\u201d, \u201cMuxtasarul viqoya\u201d, \u201cTuhfatul fuqaho\u201d va \u201cNurul iyzoh\u201d kabi asarlarni misol qilish mumkin. \u201cMuvatto\u201d asarida esa, bu tartibdan bir ozgina farq ko\u02bbzga tashlanadi. Asar \u201cNamoz boblari\u201d degan bo\u02bblim bilan boshlanadi. Uning birinchi bobi \u2014 \u201cNamoz vaqtlari bobi\u201ddan so\u02bbng\u00a0 birdaniga tahoratga tegishli 13 ta bob, uning ketidan g\u02bbuslga tegishli 4 ta bob, so\u02bbngra tayammum, hayz, istihoza va boshqa poklik masalalariga taalluqli 9 ta bobni o\u02bbtkazib, \u201cAzon va iqomat haqidagi bob\u201d va \u201cMasjidga yurib borish va masjidlarning fazilati haqidagi bob\u201d ketma-ket keltiriladi. Ana shundan so\u02bbng namoz masalalari tegishli yana 70 ta bob bilan \u201cNamoz boblari\u201d bo\u02bblimi yakunlanadi. Mazkur bo\u02bblim jami 100 bobni o\u02bbz ichiga oladi. E\u02bctibor berilsa, poklik masalalari kelgusi davrlarda yozilgan fiqhiy asarlardagi singari alohida bo\u02bblim sifatida emas, balki namoz durust bo\u02bblishining shartlari bo\u02bblimining bir qismi sifatida taqdim qilingani ko\u02bbrinadi. Qozixon \u201cfiqhdagi ulug\u02bb asl\u201d deb atagan e\u02bctiborli \u201cAl-Jomius sag\u02bbir\u201d (Kichik to\u02bbplam)da Imom Muhammad xuddi shu uslubni tutgan. Ya\u02bcni u yerdagi 40 ta fiqhiy mavzular\u00a0 \u201ckitob\u201d nomi bilan quyidagi tartibda keladi: Namoz kitobi (tahorat masalalari uning ichida bayon qilinadi), Zakot kitobi, Ro\u02bbza kitobi, Haj, Nikoh, Taloq, Iylo, Zihor, Qul ozod qilish, Qasamlar, Hadlar, O\u02bbg\u02bbrilik, (Harbiy) yurishlar, Savdolar, Kafolat, Havola, Zomin bo\u02bblish, Qozilik, Vakolat, Da\u02bcvo qilish, Iqrorlik, Sulh, Muzoraba, Vadia, Oriya, Hiba (hadya), Ijaralar, Mukotab, Ma\u02bczun (izn berilgan), G\u02bbasb (molni tortib olish), Shuf\u02bca, Muzoraa (ekinda sherikchilik), Xiroj, (Hayvonlarni) so\u02bbyish, Karohiyat, Ichimliklar, Ov qilish, Garov, Jinoyatlar, Vasiyatlar va nihoyat, Tarqoq masalalar kitobi. [6: J. 2, B. 452-453.]<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ko\u02bbrinib turganidek, asar ikki katta qismga: 1) Ibodatlar qismi va 2) Muomalot qismiga bo\u02bblingan. Tahorat masalalari Namoz kitobi ichiga kiritib yuborilishi va undan keyingi mavzularning tartiblanishiga qarab imom Muhammad bu tartibni imom Molikdan istifoda etganini payqash mumkin. Ilmning taraqqiy etish bosqichlarida barcha sohalar kabi fiqh fani ham asta-sekin sayqallanib, mukammallashib borgan. Imom Muhammad \u201cMuvatto\u201dsi va uning \u201cAl-Jomeus sag\u02bbir\u201d kabi fiqhiy asarlari ana shu jarayonning bir bo\u02bbg\u02bbini bo\u02bblib xizmat qilgan. Fiqh mavzularini tartiblashdagi yangilik imom Muhammadning imom Molikdan o\u02bbzlashtirib, ilm sohasiga tatbiq etgan yutuqlaridan biridir. Kelgusi davrdagi faqihlar bu yutuqdan samarali foydalanib, kitob ta\u02bclif etishda \u201cMuvatto\u201dni o\u02bbzlariga qo\u02bbllanma qilib olganlar va uning uslubini rivojlantirganlar.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cMuvatto\u201dning fiqh boblariga ko\u02bbra tartiblangani, tuzilishi murakkablikdan xoli, hajmi ham katta bo\u02bblmagani bois har qanday tolibi ilm uni oson o\u02bbzlashtira oladi. Boshlovchi talaba fiqhiy xulosalarni yodlash bilan cheklanmay ilk bosqichdayoq ortiqcha mashaqqatsiz har bir mavzuni uning dalili bilan birgalikda o\u02bbrganadi. Imom Muhammadning tez-tez uchrab turadigan izohlari, imom Molik bilan bahsga kirishib, o\u02bbz qarashini dalil yordamida isbot qilishini kuzatish orqali dalildan xulosa chiqarish usullari bilan tanishadi. Yana bir muhim jihati, talaba bu asarda ilmiy munozara odobidan amaliy ta\u02bclim oladi. Imom Muhammad ko\u02bbplab masalalarda imom Molikka xilof qilgan bo\u02bblsa-da, unga hurmat saqlab biron bir o\u02bbrinda nojo\u02bbya so\u02bbz aytmaydi, mavzudan chetga chiqmaydi, balki \u201cBiz buni olmaymiz, lekin Abdulloh ibn Mas\u02bcudning so\u02bbzini olamiz\u2026\u201d deganga o\u02bbxshash so\u02bbzni aytib, shu zahoti o\u02bbzining dalilini keltiradi. [7: B. 229]Muayyan bir kitob, qaysidir ustoz yoki biron bir mazhabga mutaassib bo\u02bblish hamda o\u02bbzgacha fikrlarni keskin rad etish illatidan salomat bo\u02bblishda kitobning bu jihati g\u02bboyatda ahamiyatlidir. Bu gap hanafiy mazhabi doirasidagi fatvolarga ham tegishli. Zero imom Muhammad \u201cMuvatto\u201dning bir qancha o\u02bbrinlarida ustozi \u2013 imom\u00a0 Abu Hanifaga xilof o\u02bblaroq fatvolar bergan. Bu bilan mazhab doirasidagi fatvolar ko\u02bbpayib va kengayib, faqihlar uchun turli sharoitlarda zamon va makonga eng munosib fatvoni tanlash imkoniyati yuzaga kelgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Muhammad \u201cMuvatto\u201dsining tartibini uning oxirgi bobi bo\u02bblgan Tafsir bobi misolida ko\u02bbrish mumkin. U yerda jami 11 ta hadis kelgan bo\u02bblib, ulardan 2 tasi marfu\u02bc, 5 tasi mavquf va 4 tasi maqtu\u02bcdir. Uch o\u02bbrinda Imom Muhammad keltirilgan xabarlarga o\u02bbz munosabatini bildirgan.
