Ammo ulamolar nazdida fiqh ilmidagi o\u02bbrni hadisshunoslikdagidek, ochiq-ravshan namoyon bo\u02bblmagan. Bunga sabab fiqhdagi ijtihodining barchasi maxfiy hisoblanadi. Shu sababli fiqh borasidagi peshvoligi faqat ikkita ish bilan chegaralanib qolgan. Birinchisi, ulamolar haqqiga maqtovlar aytib, \u201cFaqih\u201d deb sifatlagan bo\u02bblsa, ikkinchisi, Imom Buxoriy o\u02bbz \u201cSahihi\u201dda tuzgan boblarning sarlavhalari fiqhda peshvo bo\u02bblganiga ishora qilgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Demak, ulamolarning Imom Buxoriyni olqishlab, \u201cFaqihlarning sayyidi\u201d, deb sifatlashi uning hadis ilmidan tashqari fiqhda ham peshvo bo\u02bblganiga dalil bo\u02bbladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Buxoriyning kotibi Abu Ja\u02bcfar Muhammad ibn Abu Hotim Varroq aytadi: \u201cHoshad ibn Ismoilning bunday deganini eshitdim: \u201cMen Basra shahrida bo\u02bblganimda, Muhammad ibn Ismoilning bu shaharga kelayotganini eshitib qolib, uni kutib olish uchun chiqdim. U kelgan vaqtda Muhammad ibn Yosar : \u201cBugun bu shaharga faqihlarning sayyidi kirib keldi\u201d, deb olqishlab kutib oldi\u201d [3.2\/6].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ahmad ibn Yosar aytadi: \u201cAbu Abdulloh Muhammad ibn Ismoil ibn Ibrohim ibn Mug\u02bbira Ju\u02bcfiy ilm tolibi, odamlarning suhbatdoshi va hadis yo\u02bblida safar qilib, unda mohir edi. Hadisdagi bilimi va yodlash qobiliyati juda kuchli bo\u02bblib, shu bilan birga, fiqh ilmini ham o\u02bbrganar edi\u201d [3.2\/6].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Buxoriyni fiqh ilmida Imom Ahmaddan afzal ko\u02bbrganlar ham topiladi. Abu Mus\u02bcab Ahmad ibn Abu Bakr Madaniy bir davrada: \u201cMuhammad ibn Ismoil bizning nazdimizda Imom Ahmaddan ko\u02bbra faqihroq edi\u201d, dedi. Bu paytda unga shu yerda o\u02bbtirganlardan biri e\u02bctiroz bildirib: \u201cChegaradan oshirib yubording\u201d, dedi. Abu Mus\u02bcab unga javoban aytdi: \u201cAgar Imom Molikni hayotlik chog\u02bbida topib, uning yuziga nazar qilib, keyin Muhammad ibn Ismoilning yuziga qaraganingda edi, albatta, ikkalasi fiqh va hadis ilmida barobar ekan, deb aytar eding\u201d [3.2\/19].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ya\u02bcqub ibn Ibrohim Davroqiy aytadi: \u201cMuhammad ibn Ismoil bu ummatning faqihidir\u201d [3.2\/22]. Shunga o\u02bbxshash gapni Naim ibn Hammod ham Imom Buxoriyni sifatlab aytgan [3.2\/24]. Is\u02bchoq ibn Rohavayh bunday degan: \u201cEy yoshlar jamoasi! Bu yosh yigitga e\u02bctibor bering va undan hadis yozib oling. Agar u Hasan ibn Abu Hasan (Hasan Basriy) zamonida yashaganida edi, hadis va fiqh ilmini o\u02bbrganishda, albatta, unga odamlarning ehtiyoji tushar edi\u201d [3.2\/27].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Shunga o\u02bbxshash Imom Buxoriyning fiqhdagi mavqei haqida gapirib o\u02bbtgan ba\u02bczi ulamolar uning haqqiga mana shunday sifatlar bilan ko\u02bbp maqtovlar bitgan. O\u02bbz o\u02bbrnida bu maqtovlar xuddi ulamolar tomonidan Imom Buxoriyning fiqhda peshqadam ekaniga ijmo\u02bc qilganga o\u02bbxshaydi. Biz fiqh borasida uning haqqiga aytilgan ochiq va ma\u02bcnoli maqtovlarni keltirishni lozim topdik. Qolaversa, uni \u201cFaqihlarning sayyidi\u201d, deb sifatlab, hatto Imom Ahmaddan afzal qilib, Imom Molikka tengladik. Bularning barchasi shak-shubhasiz Imom Buxoriyning fiqhda peshqadam bo\u02bblganidan dalolatdir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Navaviy \u201cSahihul Buxoriy\u201dga yozgan sharhi cho\u02bbzilib ketganidan uzrlanib, bunday degan: \u201cAgar odamlarning g\u02bbayrati va intilishi zaiflashmaganda va keng hadis kitoblarga qiziqishi kamaymaganda edi, albatta, \u201cSahihul Buxoriy\u201dga yozgan sharhimni takror kelgan hadislarni kiritmasdan 100 mujalladga yetkazgan bo\u02bblar edim. Chunki bu kitobning foydasi ko\u02bbp va u islom qonunshunosligidagi maxfiy va zohir uslublarni qamrab olgan asardir\u201d [4.18].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Buxoriyning fiqh borasida peshvoligiga sabab bo\u02bblgan omil, ya\u02bcni o\u02bbz \u201cSahihi\u201dda tuzgan boblarning sarlavhalari uning fiqhda peshvo bo\u02bblganini ko\u02bbrsatishi borasida Hofiz ibn Hajar bunday degan: \u201cImom Buxoriy o\u02bbzi yozgan \u201cSahihul Buxoriy\u201d kitobi fiqhiy foydalar va chuqur ma\u02bcnoli gaplardan xoli bo\u02bblmasligini bilgach, o\u02bbzining aqlu farosati bilan hadis matnlaridan ko\u02bbpgina foydalarni chiqarib olib, ularni hadisning ma\u02bcnosiga munosib bo\u02bblishiga qarab, kitobning boblarida sarlavha o\u02bbrnida keltirdi. Yana u yerda hukm oyatlariga e\u02bctibor berib, ulardan fiqh borasida asosli dalillarni chiqarib oldi va ularni tafsir qilishga ishora qilib, keng yo\u02bblni ochib berdi\u201d [6.10].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yana ulamolarning ijmosi shuni ko\u02bbrsatadiki, Imom Buxoriyning sahih hadislarni ajratib, saralagandan keyingi maqsadi hadis matnlaridan ko\u02bbpgina ma\u02bcnolarni chiqarib olish bo\u02bblgan. Aynan shu yo\u02bbl u kishining fiqhi hisoblanadi [7.1\/19].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Buxoriyning fiqhda peshqadam bo\u02bblganini bildiradigan sabablardan yana biri \u201cSahihul Buxoriy\u201dni sharhlagan ulamolarning shariat ilmida o\u02bbz o\u02bbrni bo\u02bblganiga qaramay, uning maqsadini bayon qilishda har xil qarashlar bildirganidir. Kimki sharhlovchilarning \u201cSahihul Buxoriy\u201dda boblar uchun tuzilgan mavzulardagi maqsadni yoritib berishdagi so\u02bbzlarini va o\u02bbsha mavzudagi dalillarni o\u02bbqisa, Imom Buxoriyning fiqh borasida peshqadamligiga yana bir bor ishonch hosil qiladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Buxoriy hadis kitob yozish bilan birga shariat qonunlarini chiqarib olishda quyidagi dalillarga suyangan:<\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Qur\u02bconi karim.\u00a0<\/strong>Imom Buxoriy Alloh taolo kalomidan ko\u02bbpgina oyatlarni boblarning sarlavhalariga qo\u02bbyib, o\u02bbsha oyatlardan ajoyib dalillarni chiqarib olgan. Bunga misol, Imom Buxoriy \u201cSavdo kitobi\u201dda\u00a0<strong>\u201cUnda yana (suvni) yorib ketayotgan kemalarni ko\u02bbrasiz. Uning fazli (rizqi)dan talab etishingiz va (ne\u02bcmatlariga) shukr qilishingiz uchun (shunday qildi)\u201d<a href=\"https:\/\/www.bukhari.uz\/?p=20071#_ftn1\" name=\"_ftnref1\">[1]<\/a>,<\/strong>\u00a0degan oyatni Matordan kelgan rivoyatga ko\u02bbra, dengizdagi kemaga tijorat qilish uchun minishning joizligiga dalil qilib keltiradi. Bu bilan Imom Buxoriy xuddi Abu Dovudning \u201cJihod kitobi\u201dda Abdulloh ibn Amr ibn Osdan: \u201cDengizdagi kemaga faqat haj yo umra yoki Alloh yo\u02bblida dushmanga qarshi urush uchun chiqiladi\u201d [5.5\/145], deb rivoyat qilingan hadisga raddiya bergandek bo\u02bbladi. Chunki, Abu Dovud o\u02bbzi bu hadisga izoh berib, bunday degan: \u201cBu hadis juda zaifdir. Uni rivoyat qilgan Abu Abdulloh va Bashir noaniq roviylardir\u201d [7.145].<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Sunnat<\/strong>. Imom Buxoriyning sunnatdan dalil olishda puxta bilimga va sahih hadislar to\u02bbg\u02bbrisida juda ko\u02bbp ma\u02bclumotga ega bo\u02bblgan.U hatto ko\u02bbpgina masalalarni shartiga to\u02bbg\u02bbri kelmaydigan hadisni sabab qilish bilan sarlavha tuzish orqali chiqarib oladi va o\u02bbsha sarlavha ostida shartiga mos keladigan hadislarni keltiradi.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Ijmo<\/strong>. Ulamolar ijmosi ham Imom Buxoriy nazdida dalil sifatida qabul qilingan. Shu sababli uning fikriga ko\u02bbra, agar ulamolar ijmosi qozining hukmiga qarshi chiqsa, unda qozining hukmi bekor bo\u02bbladi. Imom Buxoriy mana shu so\u02bbzini quvvatlash uchun \u201cHukmlar kitobi\u201ddagi bobga\u00a0<em>\u201cHokim shafqatsizlik qilishni yoki ilm ahliga xilof ish tutishni buyursa, rad qilinadi\u201d<\/em>, deb sarlavha qo\u02bbygan [2.551]. Bu bobda Solim otasidan rivoyat qilgan hadisni keltirgan: \u201cRasululloh sollallohu alayhi vasallam Xolid ibn Validni askarlarga boshliq qilib, Bani Juzayma qabilasiga yubordilar. Ular: \u201cIslomni qabul qildik!\u201d deyish o\u02bbrniga, bilmay: \u201cDindan qaytdik!\u201d deb yubordi (ya\u02bcni, \u201cAvvalgi dinimizdan qaytib islomga kirdik!\u201d deb aytmoqchi bo\u02bblgan). Shunda Xolid Ibn Valid ularga qarshi askarlarni jangga tashladi va ko\u02bbpchiligini o\u02bbldirib, qolganlarini asir oldi. Keyin har birimizga o\u02bbzimiz qo\u02bblga tushirgan asirimizni o\u02bbldirishni amr qildi. Men bundan bosh tortdim, sheriklarim ham shunday qildi. Qaytib borgach, bu haqda Janob Rasulullohga aytgan edik, u zot:\u00a0<strong><em>\u201cEy Parvardigoro, Xolid ibn Validning qilmishida qo\u02bblim yo\u02bbqdir!\u201d\u00a0<\/em><\/strong>dedilar, ya\u02bcni Xolid ibn Validning surishtirmay-netmay ularni o\u02bbldirganini nazarda tutdilar\u201d. Imom Buxoriy bu bobda Xolid ibn Valid boshliq bo\u02bblishiga qaramay, sahobalar uning hukmiga o\u02bbz ijmo\u02bcsi bilan qarshi chiqqanini e\u02bctiborga olgan.<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Buyuk muhaddis \u201cKitob va sunnatni mahkam ushlash kitobi\u201dda\u00a0<em>\u201cNabiy sollallohu alayhi vasallamning ilm ahlining ittifoqi haqida so\u02bbz yuritganlari va undaganlari; Ikki haram \u2013 Makka va Madina (ulamolari) ijmo qilgan narsalar haqidagi bob\u201d<\/em>, deb sarlavha qo\u02bbyib, bu bobda ibn Abbosdan rivoyat qilingan hadisni keltirgan [8.8\/507].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bundan tashqari, Imom Buxoriy sukutiy (jim turish) ijmo bilan aka-ukalar uchun bo\u02bblgan merosdagi haqdan boboning man qilinishiga qarshi Abu Bakrning so\u02bbzini hujjat qilib keltirib, boboning meros olishini joiz deb ko\u02bbrsatgan va bu haqda\u00a0<em>\u201c(Mayyitning) otasi va aka-ukalari bilan birga bobosining ham meros olishi haqida\u201d<\/em>\u00a0[1.1669], deb bob tuzgan. Unda avval sahobalarning so\u02bbzini keltirgan, ya\u02bcni \u201cAbu Bakr, Ibn Abbos va Ibn Zubayr aytdi: \u201cBobo ota (o\u02bbrnida)dir\u201d. Ibn Abbos \u201c<strong>Ey Odam bolalari<\/strong>\u201d<a href=\"https:\/\/www.bukhari.uz\/?p=20071#_ftn2\" name=\"_ftnref2\">[2]<\/a>, \u201c<strong>Otalarim Ibrohim, Is\u02bchoq va Ya\u02bcqubning millatiga ergashdim<\/strong>\u201d<a href=\"https:\/\/www.bukhari.uz\/?p=20071#_ftn3\" name=\"_ftnref3\">[3]<\/a>\u00a0oyatlarini qiroat qilardi. Bu masalada Abu Bakrga o\u02bbz zamonasida biror kishining qarshi chiqqani aytilmagan, holbuki, Nabiy sollallohu alayhi vasallamning sahobalari juda ko\u02bbp edi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ibn Abbos: \u201cMendan (keyin) aka-ukalarim qolib, o\u02bbg\u02bblimning o\u02bbg\u02bbli meros oladi-yu men o\u02bbg\u02bblimning o\u02bbg\u02bblidan meros olmaymanmi?\u201d degan. Bu borada Umar, Ali, Ibn Mas\u02bcud Zayddan boshqa qavllar ham rivoyat qilingan\u201d [1.1670].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><em>Izoh: Agar mayyitning otasi o\u02bblib ketgan bo\u02bblsa, bobosi, ya\u02bcni otasining otasi, ota o\u02bbrnida meros oladi. Ibn Abbos bunga dalil sifatida mazkur oyatlarni esga olgan. Zero, Qur\u02bconi karimda insoniyatga \u201cOdam bolalari\u201d deyilgani, ya\u02bcni Odam alayhissalom butun insoniyatning otasi deb qaralishi, shuningdek, Yusuf alayhissalom o\u02bbz bobolarini ham \u201cotalarim\u201d deb aytgani boboning ota o\u02bbrnida ko\u02bbrilishini taqozo etadi.<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Buxoriy Ibn Abbosdan boboning meros olishiga boshqa bir qiyosiy dalil keltiradi: nabira otasi bo\u02bblmaganda bobodan meros oladimi, demak, bobo ham o\u02bbrtada o\u02bbz farzandi bo\u02bblmaganda nabiradan meros oladi. Boboning meros olishi haqida ijmo sobit bo\u02bblsa-da, qancha miqdorda olishi haqida turlicha fikrlar bor [8.8\/153].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Demak, Abu Bakr boboni otaga tenglashtirib, boboni ota deb hukm chiqardilar, ammo Nabiy sollallohu alayhi vasallamning sahobalari ko\u02bbp bo\u02bbla turib, o\u02bbsha vaqtda birortasi unga qarshi chiqmadi [2.485]. Ya\u02bcni, Abu Bakrning so\u02bbzlariga hech bir sahoba qarshi chiqmasdan sukut qildi. Ularning sukut qilishi shu hukmga rozi ekanligini bildiradi. Imom Buxoriy bu masalada sahobalarning mana shu ijmosini dalil qilib olgan.<\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"4\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Qiyos.\u00a0<\/strong>Imom Buxoriy qiyosni dalil o\u02bbrnida qabul qilgan. Ammo ba\u02bczi ahli ilmlar kabi qiyosni keng yo\u02bbl qilib olmagan. Balki \u201cKitob va sunnatni mahkam ushlash\u201d kitobida,\u00a0<em>\u201cRa\u02bcy (o\u02bbz bilganicha fikr yuritmoq) va qiyosda takalluf qilish jumlasidan bo\u02bblgan ishlar qoralab aytilgan narsalar haqidagi bob\u201d<\/em>\u00a0[8.8\/496] va\u00a0<em>\u201cNabiy sollallohu alayhi vasallamning erkagu ayol ummatlariga ra\u02bcy va qiyos (o\u02bbxshatish) bilan emas, Alloh u zotga o\u02bbrgatgan narsadan o\u02bbrgatganlari haqidagi bob\u201d<\/em>\u00a0[8.8\/499] deb sarlavha qo\u02bbydi.<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Birinchi bobda Urva Abdulloh ibn Amrdan: Nabiy sollallohu alayhi vasallamning\u00a0<strong>\u201c<em>Alloh ilmni ularga\u00a0<\/em>(odamlarga)<em>\u00a0bergandan keyin uni birdan sug\u02bburib olmaydi, balki oralaridan ulamolarni ilmlari bilan qabz qilib, uni sug\u02bburib oladi. Shunda johil odamlar qoladi. Ulardan fatvo so\u02bbraladi, ular o\u02bbz ra\u02bcylari bilan fatvo beraveradi. Natijada adashtiradi va adashadi\u201d<\/em><\/strong>, deb aytganlarini keltirgan. Imom Buxoriy bu bobni Qur\u02bcon va hadis ilmiga tayanmasdan o\u02bbz fikri bilan fatvo chiqarishni qoralash maqsadida tuzgan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ikkinchi bobda Abu Saiddan rivoyat qilingan hadisni keltirgan, ya\u02bcni: \u201cBir ayol Rasululloh sollallohu alayhi vasallamning huzurlariga kelib, \u201cEy Allohning Rasuli! Erkaklar hadisingiz(ni o\u02bbrganish)da ilgarilab ketdi. Bizga ham bir kunni tayin qilsangiz, shu kunida huzuringizga kelsak, Alloh sizga o\u02bbrgatgan narsalardan bizga ham o\u02bbrgatsangiz\u201d, dedi. Shunda\u00a0<strong><em>\u201cFalon-falon kunlari falon-falon joyga to\u02bbplaninglar\u201d<\/em><\/strong>, dedilar. Ular to\u02bbplandi. U zot kelib, Alloh o\u02bbzlariga o\u02bbrgatgan narsalardan ularga o\u02bbrgatdilar\u2026\u201d [1.1806].<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Buxoriy bu bobni tuzish bilan xuddi yuqoridagi bobni ta\u02bckidlagandek, ya\u02bcni Rasululloh sollallohu alayhi vasallam ummatini o\u02bbz ra\u02bcylari bilan fatvo berishdan qaytarishlaridan tashqari, u zot ham erkak, ham ayol ummatlariga ra\u02bcy va qiyos bilan emas, balki Alloh u zotga o\u02bbrgatgan narsadan ta\u02bclim berganlarini aytib o\u02bbtayapti.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Imom Buxoriy qiyos bobini\u00a0<em>\u201cSo\u02bbrovchiga tushuntirish maqsadida Alloh hukmlarini bayon qilib qo\u02bbygan ma\u02bclum aslni bayon qilingan aslga o\u02bbxshatish haqidagi bob<\/em>\u201d [1.1807] deb nomlagan. Bu bilan qiyosga ijobiy fikr bildirib, Abu Hurayradan rivoyat qilingan hadisni keltirgan: \u201cBir a\u02bcrobiy Rasululloh sollallohu alayhi vasallamning huzurlariga kelib, \u201cAyolim qop-qora bola tug\u02bbdi. Men esa uni tan olmadim\u201d, dedi. Shunda Rasululloh sollallohu alayhi vasallam unga:\u00a0<strong><em>\u201cTuyalaring bormi?\u201d\u00a0<\/em><\/strong>dedilar. Dalolatning ma\u02bcnosi va uning izohi qanday bo\u02bbladi?\u201d<\/em>\u00a0[1.1815] deb nomlagan. Ya\u02bcni, bu hadisdagi dalil bilan bilinadigan hukm shuki, yuqoridagi oyatga binoan eshak boqishda undan zakot berilmasa-da, ammo yaxshilik yo\u02bblida boqqani uchun savob olishi ma\u02bclum bo\u02bbladi.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Natijada bu sarlavhalarning ba\u02bczisi, boshqasi bilan jam qilinganda, avvalgi tuzilgan ikki bobda ra\u02bcy va qiyosning salbiy tomoni olingan bo\u02bblsa, keyingi ikki bobda ularga ijobiy qaralgan, degan tushuncha hosil bo\u02bbladi.
